Terms and Conditions of Use

These Terms and Conditions of Use constitute an agreement between the individual or user, visitor, participant, client, contractor, vendor, partner, content creators, and production entities, referred to herein as “User or Users”, and GGA Dwarf Goat Yoga referred to herein as “GGA”, governing access to and use of the website located at www.ggadwarfgoatyoga.com, referred to herein as “website or the site”, the terms include any related websites, booking platforms, accounts, payment services, features, content, and third party softwares operated or made available by GGA.

By accessing, browsing, or using the site, the user acknowledges and agrees to be bound by these Terms. Continued use of the site constitutes confirmation that the user has read, understood, and accepted all terms set forth herein. If the user does not agree to these Terms, the user must immediately discontinue use of the site.

Privacy

Any user of the site is subject to the terms of the GGA Goat Yoga’s Privacy Policy. Please review the Privacy Policy for full details governing the data collection and privacy practices of GGA.

Electronic Communications

The user understands that visitation of the site and electronic communications with GGA, constitute as user consent to: receive electronic communications which include but are not limited to: agreements, notices, terms, disclosures, payment reminders and other electronic and or mobile communications.

Children Under Thirteen

GGA does not knowingly collect, online or offline, personal information from persons under the age of thirteen. See the GGA Privacy Policy for more details.

All users of the site must have a parent or guardian present if under 18 years of age.

Links to Third Party Sites/Third Party Services

GGA is not responsible for any third party or linked services on the site, required of users to participate with GGA services or not, and used by GGA for electronic booking, communications or public media.

The booking platform, Wellness Living, is used by the site, as a third party software. The user understands that GGA is not responsible for any terms or agreements held by and between the user and any third party service offered by GGA.

GGA Goat Yoga may share information with any third party with whom GGA has a contractual relationship to provide on the requested product, service or functionality and on behalf of the site users. See the Privacy Policy for more detail.

No Unlawful or Prohibited Use/Intellectual Property

The user is granted a non-exclusive, non-transferable, revocable license to access and use the site in accordance with these terms of use.

The user will not use the site: for any purpose that is unlawful or prohibited by these terms; in any manner which could damage, disable, overburden, or impair the site or interfere with any other users’ use; to obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the site; to modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any exploitative manner of the content, in whole or in part.

The user agrees to: observe and abide by all copyright, intellectual property and proprietary laws. This includes but is not limited to: text, graphics, logos, images, audio, logos, service and trade marks.

The user understands the site and all content held within, public or private, is property of GGA Goat Yoga and are protected by copyright, intellectual property and proprietary rights.

The user agrees to only use the site as intended by GGA for services offered.

The user is not in any form granted any licenses, express or implied, to the intellectual property of GGA except as expressly authorized by these terms.

International Users

The user agrees to comply with all applicable federal, state, and local laws, regulations, and ordinances when accessing or using the site and shall not use the site in any manner that is unlawful or prohibited by applicable restrictions or regulations. GGA operates under and in accordance with the laws of the United States. All communications, correspondence, and related documentation between the user and GGA, including those involving international matters, shall be conducted in the English language.

Indemnification

The user agrees to indemnify, defend and hold harmless GGA Goat Yoga, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney’s fees) relating to or arising out of the use of or inability to use the site, services or third parties.

The user agrees to never violate any and all policies, applicable laws, rules and regulations under the terms of this agreement.

Arbitration

The user agrees any dispute, which can not be settled by reasonable means, shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by GGA. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, GGA shall be entitled to recover its costs and reasonable attorney’s fees.

The user understands that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator.

Class Action Waiver

The user understands as a term of use of the site the user waives the rights to any and all class actions or collective actions against GGA. This includes but is not limited to: as a plaintiff or class member in any putative class, collective or consolidated group, and to be understood as two (2) or more people.

Liability Disclaimer

The information, software, products, and services included in or available to the user through the site may include inaccuracies or typographical errors. Changes are periodically added to the information herein. GGA Dwarf Goat Yoga and/or its suppliers may make improvements and/or changes in the site at any time. GGA Dwarf Goat Yoga and/or its suppliers make no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained on the site for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. GGA Dwarf Goat Yoga and/or its suppliers hereby disclaim all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by applicable law, in no event shall GGA Dwarf Goat Yoga and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, or consequential damages, or any damages whatsoever, including, without limitation, damages for loss of use, data, or profits, arising out of or in any way connected with the use or performance of the site, with the delay or inability to use the site or related services, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the site, or otherwise arising out of the use of the site, even if GGA Dwarf Goat Yoga or any of its suppliers has been advised of the possibility of damages.

Termination/Access Restriction

GGA Goat Yoga reserves the right, in its sole discretion, to terminate the users access to the site, the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Georgia and users hereby consent to the exclusive jurisdiction and venue of courts in Georgia in all disputes arising out of or relating to the use of the site and under the terms of use. Use of the site is not authorized for any individual attempting use of the site in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. User agrees that no joint venture, partnership, employment, or agency relationship exists between user and GGA Goat Yoga as a result of this agreement or use of the site. GGA Goat Yoga’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of GGA Goat Yoga’s right to comply with governmental, court and law enforcement requests or requirements relating to the users use of the site or information provided to, or gathered by GGA Goat Yoga with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and GGA Goat Yoga with respect to the site and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and GGA Goat Yoga with respect to the site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

Changes to Terms

GGA Goat Yoga reserves the right, in its sole discretion, to change the Terms, conditions and services under which www.ggadwarfgoatyoga.com is offered. The most current version of the Terms will supersede all previous versions. GGA Goat Yoga encourages the user to periodically review the Terms to stay informed of our updates.
